Prosecutor questions county's tax auction


EDWARDSVILLE, Ill. (AP) -- A prosecutor in southwestern Illinois is calling into question Madison County's auction of unpaid property taxes because he says the county treasurer failed to comply with state law.

Madison County State's Attorney Tom Gibbons says treasurer Kurt Prenzler didn't comply with an Illinois law requiring that a judge's order be obtained before the February tax sale could take place. Such sales involve delinquent tax bills being auctioned off to investors.

That failure could invalidate 2,700 sales and jeopardize $4 million in revenue for towns, school districts and other county taxing bodies.

Gibbons says it isn't clear whether any action can be taken to remedy the issue and avoid a new sale.

Prenzler says getting the required court judgment was Gibbons' responsibility.

Gibbons is a Democrat, while Prenzler is a Republican.
