Decatur man pleads guilty in 2011 shooting death

Decatur - A Decatur man accused of murder appeared in court Tuesday afternoon, entering a guilty plea for the 2011 murder of an 18-year-old.  

22-year-old Eric Cunningham made a plea deal to being a Felon in Possession of a Weapon, in exchange the murder charges for the shooting death of 18-year-old Devin Kirk are dropped.

Police say, Kirk was shot in the 900 block of West View just after 1:30 p.m. Saturday, April 30, 2011.  Kirk was taken to Decatur Memorial Hospital with gunshot wounds to his neck and back. He was pronounced dead at 4:38 p.m.

Cunningham and co-defendant 20-year-old Tre McSpadden turned themselves into police, just two days later. Both men were wanted in connection to the murder.

Under the plea agreement, Cunningham will be sentenced to 10 years in prison, followed by a mandatory 1-year supervised release, for being a Felon in Possession of a Weapon. Cunningham will be given credit for time served from his arrest on May 2, 2011 to April 14, 2014.

A jury convicted McSpadden of First Degree Murder earlier this month. His sentencing is set for May 21.
