Man who plead guilty to accidentally hitting and killing a toddler receives sentence
Decatur - In June of 2013 a 19-month-old was the victim of a hit and run, today the man who accidentally hit and killed the toddler received his sentence.
David Overlin,24, was charged with leaving the scene of a fatal accident. He plead guilty to the charges on February 19, 2014.
According to the Macon County Coroner, 19-months-old Zyonne Cooper died of head injuries. The boy was hit by a vehicle on East Garfield after he wandered into the street just after midnight. Overlin's white Ford Explorer was later found with different license plates. Overlin would later admit to police that he was responsible for the death of Zyonne Cooper.
Today in the Macon County Court the defendant and the grandmother of Zyonne embraced. She told WAND exclusively she has forgiven Overlin for her grandsons death. However, it was not enough, as the judge gave down his sentencing Thursday afternoon. Overlin asked the judge for leniency apologizing to the family in court.
Overlin will spend 6 years behind bars. He will also pay restitution fees of $1,954.93. He could have been given up to 15 years in prison.
