2 police officers will not face charges in fatal shooting

TUSCOLA - Two central Illinois police officers who shot a man to death during a January incident will not face criminal charges for their actions.

Authorities say Tommy Smith, 39, was shot to death outside of his mother's Arcola home on January 11.  According to Douglas County State's Attorney Kevin Nolan, Smith pointed a rifle at two police officers just before he was shot.  It is not known whether Arcola police officer Sean Junge or Tuscola police officer Mark Payne fired the fatal shot.

Police say officers were dispatched after a person reported that Smith was involved in a dispute with his mother.  The officers say that Smith had been drinking, and that they believed that the situation was defused at one point.  However, the officers say Smith pointed a rifle at them, which led to Smith being fatally wounded.
