Off-duty ISP Trooper, 1 other person arrested after early-morning incident

DANVILLE - Danville police say two men were arrested following an early-morning incident at a restaurant on August 2.

According to Director of Public Safety Larry Thomason, Danville police officers were dispatched to the Steak N' Shake location in the 400 block of South Gilbert at about 4:00 a.m. for a report of a person with a weapon.  Upon arriving, officers say they found an off-duty Illinois State Police Trooper, identified as Cody Garza, 28.

Police say Garza told officers that he had been disarmed by another person during a physical confrontation outside of the restaurant.  Danville police also say a person identified as Casey Mason, 27, called the Communications Center, and reported that he was outside the Danville Public Safety Building with a weapon.  Mason was taken into custody without incident.

Thomason says after a preliminary investigation, Mason was arrested on preliminary charges of aggravated battery to a police officer and disarming a police officer.  Garza was also arrested on a preliminary charge of reckless discharge of a firearm.  The incident was was reported to Illinois State Police Command.

ISP officials released a statement Monday morning, saying any allegations of unlawful conduct will be investigated, and will be prosecuted to the fullest extent of the law if found to be true.  We will provide more details as they become available.
