DECATUR, Ill. (WAND) - A Decatur man was arrested on Wednesday for killing a puppy after it had defecated on the floor of his apartment, according to police. 

Police arrested Alan Magee, 25, on Wednesday for charges of animal cruelty and possession of a weapon by a felon. 

Officers were called to the 1400 block of N Main St. for a report of unlawful use of weapon. They arrived on the scene to find several people fighting on the front porch of an apartment.

After breaking up the fight, officers interviewed several witnesses and learned that Magee had made verbal threats while holding a firearm, following his confrontation with family and neighbors regarding the killing of his dog.

Magee's girlfriend, who lives in the apartment with him, said she was getting ready for work when she heard people yelling about a dead dog. She then saw Magee place a firearm on a table near the front door of the apartment before opening the door.

Witnesses told police that Magee became frustrated with his dog, Chase, after the dog soiled the apartment. He took Chase into the foyer to be "disciplined". 

Magee's girlfriend also stated that before police arrived she heard 3-4 loud thuds and described it as if the police were banging on the door leading to the foyer of their apartment.

While searching the couple's apartment, officers located Chase, deceased, buried underneath garbage in a garbage can in the kitchen area of the apartment.

Officers also discovered what appeared to be blood on the inside of the foyer door. The suspected blood had also splattered onto the wall nearby, suggesting that something had struck it with great force.

Additionally, there were several dents in the door where the blood was found.

During a Mirandized interview, Magee told the police that he sold Chase about a month earlier. He also mentioned that he had witnessed Chase fighting with his larger dog in the kennel and later discovered Chase deceased. Upset that Chase had defecated on the floor, Magee admitted that he threw Chase against the door, clarifying that Chase was already deceased at that time.

Magee does not possess a valid FOID or CCL and has a felony conviction from Will County.
