DECATUR, Ill. (WAND) - A Decatur man charged with killing a puppy after it had defecated on the floor of his apartment will serve prison time.

Macon County court records show Alan Magee pleaded guilty to charges of possession of a weapon as a felon and aggravated cruelty to animals on September 12.

Magee, 26, was sentenced to six years in the Illinois Department of Corrections, followed by up to six months of mandatory supervised release.

On April 9, officers responded to the 1400 block of N Main St. for a report of unlawful use of weapon. Officer arrived on the scene and saw a fight breaking out on the front porch. 

Police said after further investigation they learned that Magee was being confronted by his family and neighbors regarding the killing of his dog.

Witnesses told police that Magee became frustrated with his dog, Chase, after the dog soiled the apartment. He took Chase into the foyer to be "disciplined".

While searching the couple's apartment, officers found Chase, deceased, buried underneath garbage in a garbage can in the kitchen area of the apartment. 

Magee will receive credit for the time he has already served in custody.
