DECATUR, Ill. (WAND) — The officers who shot at a man in Macon earlier this month have been ruled justified in their use of force.

A Decatur Park officer and multiple Macon County troopers fired at Oscar M. McCurry May 3 after police say he wielded a machete, stole a squad car, and pointed a shotgun at them. McCurry received treatment at a hospital and was booked into the Macon County Jail May 10.

Macon County State's Attorney Diane Couri said in a release that the officers will not face charges since "each officer was justified in his use of lethal force."

In court, McCurry was arraigned on charges of aggravated use of a deadly weapon, aggravated battery to a peace officer, unlawful possession of weapon by a felon, and possession of a stolen vehicle.

McCurry's attorney told the court he had "a mental health episode" at the time of the incident. A sworn statement from a Macon County sergeant said that McCurry told deputies that he believed his daughter was being sexually assaulted in the cab of a semi at the P&V station. Deputies got permission to check the cab and told McCurry that no one was inside, but he was unable to be convinced that his child was not in danger.

The state's attorney's office said that Illinois State Police is compiling video footage and will release it to the public.
