CHAMPAIGN, Ill. (WAND) — The University of Illinois has issued a response to the motion for a temporary restraining order (TRO) filed by basketball player Terrence Shannon Jr.
In a memorandum opposing the motion for a temporary restraining order, the university defended its decision to suspend Shannon from the team after he was charged with rape in Lawrence, Kan. last year.
"And when the University receives information that a student is alleged to have engaged in misconduct of such a nature that the student is charged with a serious felony crime, as occurred here, an interim removal from athletics pursuant to the University’s own policies and procedures is appropriate. The matter before this Court—a Motion for Temporary Restraining Order (“TRO”)—is about how the University’s Division of Intercollegiate Athletics (“DIA”) sought to manage the challenges presented by a student-athlete’s arrest for rape and sexual battery."

Shannon and his attorneys believe the DIA student-athlete misconduct policy ignores "the fundamentals of due process and the presumption of innocence."
A hearing was scheduled for Friday. If the temporary restraining order is granted, the next legal step would be a preliminary injunction hearing.
