SPRINGFIELD, Ill. (WAND) - Former Sangamon County Sheriff's deputy Sean Grayson's attorney is appealing a judge's decision to not grant him pre-trial release.

Grayson was charged with murder after body camera video showed he shot Sonya Massey in her home on July 6.

The last time Grayson was in court, his attorneys asked the judge to release him from custody until his trial. They argued Grayson, who has cancer, could not receive adequate medical care in jail. The judge denied that motion. 

Grayson's attorneys are appealing that decision with the appellate court.

He will be due in court again on October 21 at 9 a.m.
